“Cat Bill” Analysis Essay

In his statement of veto of the â€Å"Cat Bill,† Governor Stevenson manifests sarcastic diction to appeal to common sense and knowledge, and uses examples of personification and dramatization to craft his effective argument ridiculing the bill. Governor Stevenson organizes his veto using common knowledge so that anyone of any background can comprehend his reasoning. He implies the impracticality of the bill by juxtaposing the basic effects it would have on both owners and the cats themselves. He uses subtle mockery by portraying cats as innocent and attributing their roaming behavior as a part of their nature. He depicts the cats to be naturally unbounded and indicates the absurdity of an owner trying to domestic them to the degree of escorting them on a leash. He predicts what possible conflicts passing this bill create, and the specific effects the bill would have on different areas, such as farms, villages, and cities. Stevenson even alludes to the writers of the bill to simply dislike cats, sarcastically calling the entire roaming cats situation as a â€Å"worthy cause to which its proponents give such unselfish effort.† Through his arguments relevant and understandable to anyone, Governor Stevenson is able to re veal the absurdity of the proposal, and allows his point to be clearly stated. Stevenson’s use of comparison and personification are additives to the overall effective of his veto. He plays on cats’ natural rights, creating a sense of justice versus injustice. He creates an almost eerie setting by measuring the liberty of cats to humans. By using words such as â€Å"capture† and â€Å"imprison,† the reader receives emotions of sympathy towards cats, unable to agree with the injustice they receive. Stevenson uses words of contempt, such as â€Å"hunt† and â€Å"traps,† to stir readers’ emotions to believe how evil and pagan-like these â€Å"zealous citizens† are behaving. He creates a picture of an implausible situation, such as a â€Å"cat on a leash,† allowing the reader to see how inconceivable it is. Stevenson uses examples of impossibility like these to serve his purpose – to show his reasoning behind his disapproval of the bill. Governor Stevenson created a veto that contained sufficient reasoning behind his disapproval, using techniques of organization and personification. Through his argument, he is able to obtain the reader’s sympathy towards cats. His writing is perceivable and effective in gaining the audience’s understanding.

The Bahai Faith

Religions beliefs shape peoples characters and influence their interpersonal relationships. The Bahai faith is one of today’s many religions that is attracting people from all nations. To date it has attracted over 5 million followers . The name Bahai is derived from the Arabic word Baha which means ‘glory’. â€Å"The Bahai Faith has its roots way back in the 19th century in Persia when Baha ‘u' llah; who is considered the founder of the faith, wrote books that based the foundations of the faith. † Bahai therefore emphasizes on spirituality for all human beings. The religion is mainly a draws its principles from the major religions in the world like Christianity, Islam, Jewish, Buddhism and Hindu. Basic Beliefs of the faith In this religion, there are no clergy people as because they believe that God is in control of everything and no individual can have power over other people. â€Å"Therefore, the duty to develop human resources, attract more people to the faith and to coordinate activities of the religion by ensuring that everything is in order among other spiritually building activities falls on the spiritual assembly.† These are individuals who have been elected by the followers to serve others and offer guidance on the Bahai principles. Thus, these institutions are run according to the Bahai texts. Spiritual assemblies therefore exist at the local as well as national levels. Every adult is considered as a spiritual leader as they can instill positive values to other members of the community by interacting with them. Oneness of all religions The foundation of all religions in the world are based on the same fundamental principles such as love, serving each other, believe in one God among other things. This shows that they are one when looked from a different point of view and it is this idea and principle the Bahai is all about. â€Å"Human thinking and certain superstitions have clouded they way they relate with othe rs and this has contributed to the divisions in society and the decay of civilization. † Therefore the ideal spirituality is founded in harmonizing the various beliefs which are founded in both religion and science in one unified religion. â€Å"The Bahai faith has therefore incorporated the Western as well as the Eastern traditions in its teachings and laws.† The Bahai followers do not have a standard way of enrolling people to the movement. This is because they are made up of people from various denominations and sects who seek to fid fulfillment in a religion that gives them the peace and love that they cannot get from other places. Science and Religion Science and certain religions have always contradicted themselves in a number of issues. This is mostly seen where it is believed that God created human beings while science on the other hand states that human beings evolved. The Bahai faith says that real science as well as religion is not supposed to contradict each other and that the two depend on each other. If people concentrate on one aspect and disregard the others, they will lack certain important elements which can contribute to negative behavior. This is because each enhances in explaining why, when and how certain things occur. The Bahai scholars say that if there are any cases of conflict, then it is because of human miscalculations as everything on earth is supposed to be in unison.By understanding how things happen, people become more knowledgeable and this goes to show the importance of the harmony between science and religion. Adherents to the Bahai teachings believe in making the world a better place to live in hence the Bahai Religious movement tries to link people of all backgrounds which include the different religions plus races so as to enhance international understanding. They believe in one God who is the creator of everything that is on earth and who communicates with his people through messengers. They refer to him as bei ng all powerful and for this reason, no one on this earth who can be likened to him or take his place. God therefore serves as an example of good deeds that other human beings can emulate. The followers therefore have to continually learn to love and serve him by praying and meditating. Prayer is important and it is very important and that is why the believers especially those aged 15- 70 years have to offer obligatory prayers. These prayers are conducted individually as group prayers are not allowed unless those ones read from writings. Fasting is encouraged mainly follows the Islamic way and takes place in the month of March for a period of two weeks. During this time, people pray for their welfare as well as those of others. Human beings are the central and most unique creations of God. â€Å"They are therefore supposed to live as live holy and pleasing lives in the eyes of the most high as this connected them.† Bahai followers therefore believe that if a person dies, they can either go to heaven or hell depending on how they lived their lives where they can either be closer or further to God spiritually. Equality of all persons is one thing that the Bahai tenets stress on. By being equal, it means that both men and women are treated equally and children of all backgrounds have access to proper education. To achieve this, they try to eradicate all forms of injustice in society by embracing cultural diversity and treating all persons equally as more can be learnt from other people who have different belief systems.â€Å"People are also not supposed to discriminate others on the basis of their status of wealth or nationalism as this divisions are the ones that give rise to hate which gives rise to tensions and as they build it leads to people engaging in inhuman acts that are very wrong according to the law and not pleasing to God. † The Bahai faith draws examples that are used by central figures in other religions. Though they borrow most thing s from other religions, they have their own laws as well as scriptures that make the religion unique.Religious history is expressed in a series of manifestations where lessons are drawn from various experiences that people face. This religious movement is continual and is believed to be never ending. Teachings The Kitab-i-Aqdas (The Most Holy Book) is the spiritual book which was written by Baha ‘u' llah lays the foundation and laws that the followers of the religion are guided by. â€Å"It also deals with prophesies, how institutions and people should relate with each other and how it can be used to aid in passing of sentences in the judicial law systems.† The laws have also set rules for acceptable standards in the society. Since there are a lot of evils in society related to using drugs and alcohol, the Bahai religious movement prohibit the use of illegal substances mainly drugs and drinking alcohol. If a person is found to have engaged in arson, according to Bahai t eachings, when they are accorded the death penalty, they will be burnt. Offenses such as murder are punishable by law and a person found to have committed is either sentenced to death or life imprisonment. From this we can see that they involve the judicial systems in place in bringing justice to society. Religion and deeds Like all religions, offering back to the community is a good gesture as it enables the community to fund its projects, operate efficiently and also help the disadvantaged in the society. Bahai’s are expected to give back to the community no matter how much they have as that is between them and their God on top of this, they are also supposed to make a contribution of 19% of their income according to the law to serve the same purpose.Financial contributions made by non-Bahai believers however are never accepted. Before the religion came to being, little was said about peace. Leaders in today’s society are however recognizing that without religious und erstandings, it is difficult to change people’s perceptions and this is what is giving rise to the evils in today’s society. Women Most women have found solace in this religion as it passes the various ideals that they would like to see in the world. This is because both the men and the women are treated equally.Bahais believe that by eradicating past beliefs which are discriminatory and ignorant, they are able to enhance the progress of various individuals. This is rooted from the fact that both genders receive equal education therefore they can choose the careers that are suitable to them. In return, they are acceptable in the job market for ant position because they are qualified. This has enabled women to take up professions in careers that were considered to be predominantly the strong holds of men for example being political leaders, being part of the top managers in various organizations and even becoming police chiefs.Family and marriage Family and marriage are considered to be sacred in the Bahai faith. The acceptable age of getting married is 15 years if the participants are willing because no one is supposed to be married off by force. Marriage is only supposed to happen between a man and a woman. Therefore, same sex marriages or relationships are therefore forbidden. Marriage is not restricted to certain religions or races as people are free to marry whoever they love and would like to spend the rest of their lives with. When people get married, the husband to be is supposed to pay dowry which will be dependant on his and also his family’s financial status. The Kitab-i-Aqdas, allows a man to marry two wives as long as no one is favored over the other. This has however been interpreted to mean that monogamy was the principle that was being emphasized on. Adultery and fornication is not allowed. People who have been discovered to have engaged in this act will be required to pay a fine at their local spiritual assembly.â€Å"Divor ce is discouraged in the Bahai faith but when two people cannot get along or an unjust act has been committed, they are allowed to divorce but this will be made legal after a year when the couple has not been able to reconcile. † Parents are supposed to nurture their children in proper manner as well as ensure that their children are well educated. In case the family is restrained by finance, the daughter over the son in the family will be allowed to go to school. This is because the girl in future will be the first one to ensure that her children are educated.â€Å"Women are the first mothers and are teachers of their children from the time they are born, it is therefore necessary that they are educated than the men. † For the next of kin to be able to inherit anything a will has to be written. Exceptions however, can be allowed when a person dies without having written one. The deceased property is then distributed equally among the heirs and where they cannot be iden tified, it will be taken to the local spiritual assembly. Enhancing Global PeaceThe world is changing and things such as transportation, communication, industrialization and the independence of people as well as countries have radically changed people’s lives. â€Å"Moreover, they have made countries dependant on each other for various basic goods, essential commodities such as oil, expertise through skilled personnel and incorporation of information and technology to enable countries industrialize. † As different people interact, there are bound to be conflicts whish require a proper mechanism for solving disputes.Bahaism therefore, tries to ensure that there are proper avenues for nations to solve their problems so as to reduce the cases of war which has subjected nations to poverty. The Bahai religious movement therefore ensures that global unity is enhanced by emphasizing on loving fellow neighbors. In addition the teachings say that real inner peace cannot come un less people decide to treat others as they would like to be treated if they were in similar positions. Moreover, they have developed international reforms and institutions that can enhance their goals and objectives so as to put and end to war, eradicate immoral intentions and create a system of corporation among nations. Conclusion Bahai faith has defined various laws and policies that seek to address most of the problems that are faced in the world today and have addressed every issue be it social , economical, environmental among other things. It is therefore a religion that is focused on enhancing global unity and peace which the world is in need of to curb the various problems and issues that are emerging.Bahai faith has therefore revolutionalized religions by enhancing individual and community transformation. Course Content Portfolio Essay Example | Topics and Well Written Essays - 1000 words

Course Content Portfolio - Essay Example The course objectives described in the Syllabus describe the tangible application of theory as it applies to the health organization. My lesson plan objectives iterate the tangible steps by which these fundamental learnings will be absorbed and discussed. It is not only the structured hierarchies and systems in place that determine human behavior, it is the attitudes, loyalty structures, interpersonal relationship developments, ego versus emotional humility, and even socio-economic differences that distinguish accepted values related to power distance and manager/subordinate relationships. My plan objectives describe the importance of understanding advanced level psychology and social studies in order to achieve the ultimate goal of successfully persevering and thriving amid difficult or challenging health care environments. My secondary objective is to provide students with specific knowledge regarding organizational structure and organizational politics to ensure students recognize the complexity of human relationships. It is necessary to understand the real-life systems and organizational hierarchies that exist and how these have inter-dependencies which directly influence quality of relationships and political authority chains. My main objective is to teach students how to behave in quality and less-than-quality environments, thus giving an emphasis on teaching as it relates to self-restraint, behavioral modification, and professionalism. It flows from the objectives listed on the syllabus by highlighting the specific obligations and responsibilities of the student when dealing with conflict scenarios or stern authority actors in the organization. The Instructional Approach Role playing exercises are the most fundamental method of learning to facilitate the transition from understanding theory to practical application within the health care organization. Role playing creates a story by which student actors are offered diversity in multiple roles of subordin ation and authority. Harris (2007, p. 111) identifies that â€Å"stories resonate with life experiences and remind people of how they fit into their culture and connect to others’ culture.† The University of Wisconsin (1995) further supported that when the student is put into the role of educator, they are more likely to be engaged and achieve comprehension of what is being taught, as was described in the course syllabus. I will be providing a forum for diverse expression within a variety of instructor-led scenarios to improve retention and serve as an assessment tool as to whether or not students are grasping the concepts of transforming theory to application. Role playing also improves empathy toward others, increases confidence and self-esteem, and decreases inhibitions (Parrish, 2004). These are necessary behavior patterns required to exhibit emotional intelligence and restraint when decorum demands it in difficult health care situations and they require my talents to effectively teach. Nourse (1995) offers that students will often embrace the teachings of guest speakers as it enhances classroom variety and adds â€Å"

Compare ketogenic diet, the Zone Diet and the Atkins Diet. Compare and Essay

Compare ketogenic diet, the Zone Diet and the Atkins Diet. Compare and evaluate each in light of known science and practical experience - Essay Example However, it is more of a nutrition control philosophy, rather than a series of shakes, or a workout regimen. The diet has a ratio system that splits carbohydrates, proteins, and fats by an aspect of 40/30/30, respectively. There have been mixed empirical results, as with many commercial diets, because consumers tend to have different degrees of commitment, and lose weight in different ways. The Atkins Diet is a marketed diet that is designed with consumers in mind, but can be followed without purchasing. Unlike the Zone Diet, Atkins advocates eliminating carbohydrates as much as possible, especially in the form of breads. People can adjust this diet to different circumstances, with some limited difficulty; for example, a person on the Atkins diet could order a hamburger at a restaurant, but they would have to remove the bun, and eat it as if it were a steak. Some claim the Atkins Diet leads to unhealthy saturated fat

Point of View - Essay Example The weather is so bright and white like an ocean. A sparrow comes flying from nowhere and rests at the branch of the bottlebrush tree. As it sits, the delicate branch slightly sways in the air with the impact of the sparrow’s weight and a bottlebrush flower falls down into my lap, as if it is a gift of nature to make my experience more memorable. The sparrow inflates its body filling air in its feathers to make a shield against the cold air of the atmosphere. I have never felt as close to and drawn toward the beauty and innocence of Mother Nature as I feel in these moments. My line of sight takes a 60 degree shift in the vertical plane as it moves from the sparrow up on the tree’s branch to the two girls holding hand in hand jumping their way up to the school over the road in front of me. Their sight takes me back to the time when I was their age and used to go to school with Lisa, my best friend and neighbor. They giggle as they pass by. Their laughter breaks the quiet ness and calmness of the surroundings and adds more life and pleasure to it. Soon after that, I hear the sound of bells approaching from a nearby Church, forming a soothing melody. It has been half an hour and the bus has not arrived yet. The fog in the air increases. My vision is obstructed by heavy mist in the air. I am red in the nose and finger tips and white in the face with cold. I seem to be catching flu. The fragrance of the pink roses and the bottlebrush that I enjoyed 30 minutes ago seems to be receding. I blow my nose but can’t really feel the friction of the tissue paper against my nose because of numbness. I throw the tissue paper away. I need another tissue paper but I have no more. I start feeling hungry as I have not had my breakfast since I got ready for the school in a hurry. I take the biscuits out of their pack in my bag, but they have become soggy and have absorbed moisture from the atmosphere. I miss the crunchiness of a dry biscuit and the

Privacy and Internet Policy Essay Example | Topics and Well Written Essays - 1000 words

Privacy and Internet Policy - Essay Example Identity theft is not a new happening. It has been around for ages now and have transformed from using the names of deceased people for voting or turning to crime that is against the social welfare. The surge of pre-approved credit cards, pre-approved loans and unsolicited credit card checks along with the ease of accessibility and reach of the Internet has made identity theft a crime that can fool anyone and lead to overwhelming financial costs for the victims (Stanley, 2008). James Moor (2009) observes that a policy vacuum exists regarding the usage of computer technology. The increased range of opportunities that computers provide also necessitates the development of more comprehensive policies to guide actions. Advancement in technology has given rise to greater vulnerabilities in the security of systems; this has been the case for websites too. Due to the chances of access by unauthorized agents, websites often develop web privacy policies. Internet policies can be used by a num ber of bodies ranging from companies and schools to web based sellers and vendors. Regardless of how dedicated or vaguely controlled the web servers, the level of risk that these bodies are exposed to and their adherence to an Internet privacy policy is not the same. If companies do not observe a concrete security system for the protection of information, then the gap between the intended level of security and identity theft protection system is widened and manifests itself when a security breach occurs. It needs to be emphasized that the range of attacks and risks to the system from outside sources is very diverse and complicated. Web-based attacks such as identity theft, common gateway interface code etc lead to drastic consequences internal intrusion, receipt or dissemination of a malicious code, decrease in the security fortressed by network security procedures and misrepresentation and authentication problems. Moreover if a system is exposed to high levels of internet identity theft, people would not trust the system anymore (Vacca, 2003). There are various measures that are employed to protect the web sources from intrusions and identity theft. According to Vacca (2003) one of this is the development and effective enforcement of an Internet policy which is meant to cover and develop management, usage and processes associated with configuration in the context of identity theft protection. Internet service providers should take into account the privacy legislation policy and should be able to not only understand it but also comply with it. Vacca argues that one of the best practices for online identity theft protection is openness, for which companies need to make identity theft policies and practices mandating the management of personal information in an open yet responsible manner. The website of the company should encompass an accurate and comprehensive identity theft policy. In particular, the privacy policy should coherently divest the responsibilitie s of organization as well as the information practices. The government places great emphasis on the protection of financial businesses, workplaces etc against identity theft. A privacy policy serves three main purposes. It tells the user about the information and security policies of the company. It gives the consumer information about the range of options that he has

Project paper Research Example | Topics and Well Written Essays - 1500 words

Project - Research Paper Example Diversity has also been observed to be beneficial at the level of management. This is because when a diverse board of members has, then the board of directors is able to come up with different solutions to a single problem and it is thus easy to choose the most appropriate solution to a particular problem. This enhances the decision making process unlike a situation where all the board members have the same mindset and come up with limited alternative solutions to a particular problem making decision making less effective. Communication is another aspect of management that has attracted a lot of attention lately. It has been recognized that communication within an organization and between the various stakeholders defines the overall organization success (Lott, 190). When dealing with a diverse workforce and diverse clientele, the message intended to be passed across is likely to be misinterpreted due to existence of different kinds of communication barriers. Poor communication often leads to misunderstanding and conflicts between people of different backgrounds. Managing diversity and ensuring good communication involves understanding the culture of the diverse groups of people. Overcoming barriers such as stereotyping and language barrier is an important step towards overcoming problems arising from poor communication when dealing with people from diverse backgrounds. Where's the Pig Business Case Study Example | Topics and Well Written Essays - 1250 words

Where's the Pig Business - Case Study Example The context of the promotional tool used has been discussed based on the main theory of cross cultural marketing. McDonald’s is a brand with a wide global presentation and it has to adjust accordingly when it comes to diverse cultures. Cross cultural marketing is an important aspect that global brands have to pay heed to. The case states how the difference between the promotional activity in Singapore and Hong Kong created a problem for McDonald’s and how the firm eventually resolved the problem by taking appropriate measures. In 2010, McDonald’s incorporated a new promotional theme in its promotional activities. It decided to incorporate the Chinese astrology into its promotion. It found out that the Chinese calendar holds great importance for the Chinese people. The Chinese astrology comprises of 12 animal signs which include rat, ox, tiger, rabbit, dragon, snake, horse, sheep, monkey, rooster, dog and pig. McDonald’s started offering 12 little Doraemon toys each of which represented a Chinese zodiac sign. The promotion came to be known as Doraemon Lucky Charms Promotion. The toy was to be purchased by the customers along with the purchase of the McDonald’s Happy Meal. This promotion was successful when it was implemented in Hong Kong. The corporations faced no problem as 95 percent of the population of Hong Kong had a Chinese ethnicity. Case Issues The main problem was raised when the same promotional strategy was modified when implemented in Singapore. ... This modification created a chaos for the McDonald’s Corporation and there was an upheaval in online blogs. The main point used to hit the corporation was that it does not respect the Chinese culture. McDonald’s was blamed for not conducting market research. Many critics raised a point that McDonald’s Corporation did not take sufficient time to think through the promotion. This whole modification stirred up a controversy as it offended the majority race in Singapore and was needed to be addressed before the brand image of McDonald’s got tarnished in Singapore. Another problem was faced when some customers said that there was no reason of buying an incomplete Doraemon collection set without a pig toy. It seemed like all minorities of Singapore except Muslims were not happy with this modification and on top of all it was the majority that got most offended. It was believed that on cross-cultural sensitivity McDonald’s over reacted. Malay culture prohi bits the consumption of pork, but McDonald’s on its own perceived that Malays will be offended by a pig toy. In addition many customers, in order to gather the 12 pieces animal collection, had to order it through their friends who lived in Hong Kong. The promotion was offered in Hong Kong. McDonald’s finally realized its’ mistake and apologized to the public of Singapore through the advertisement and its website and announced that the pig toy will be available. But this was long after the lunar year. The corporation invited its customers who were interested in buying the pig toy to visit the website and click on the Doraemon Lucky Charms Poll to indicate their interest. The apology and availability of the pig toy did not please the masses instead pacified only some publics. It

Play Critque Essay Example | Topics and Well Written Essays - 500 words

Play Critque - Essay Example Clearly, the hero naturally has a lot less individuality away from his intrusiveness. Additionally, he is ably disposed to place himself in the wrong place, and lament the aftermath. Initially, what makes The Haunting of Hill House a bright as well as clever story, is that it ingeniously manages to lay out a fence in the reader. For example Eleanor Vance, the youthful woman around whom the creepy events of this great novel cluster together, is no mean feat. In any case, Eleanor Vance is lulled into the thrilling escapades by the house. Partly, Eleanor comes out as an authentic character, rather than an apparatus of the narrator. She is, on the same length, she carries herself with a certain air of peculiarity. She is an outstanding person, complicated even, while she is capable of attracting the reader’s sympathy. Eleanor consciously adeptly, even viscerally manages to bring to us the experience of the novel through her undertakings. In part, Eleanor’s horrors, escapes and experiences also become partly ours. Her pain, her happiness throughout the book ably manages to evoke the reader’s sympathy. Additionally, the category of this psychological ghost story still is somehow tinier. The horror effect of The Haunting Hill House concentrates on the suspension of limitations, between the living and the dead. Also, the suspension of boundaries in this story turns on things that are outside the body, and those that ought to remain inside. Given, it also worth to not that the in psychological ghost story, the dispensation of certain boundaries tend to bend toward the mind and the exterior world, which clearly are two distinct things. For instance, as Eleanor’s resistance begins to crumple, she comes to herself and starts to ask her questions. In other words, when one trudges through the whole book, he or she gets a general idea that Eleanor might be the one haunted, or simply the one haunting. The events

Within IJV’s one or more of the parties is located where the operations of the IJV take place and also involve a local and foreign company. Basic Elements of an IJV Contractual Agreement. IJVs are established by express contracts that consist of one or more agreements involving two or more individuals or organizations and that are entered into for a specific business purpose. Specific Limited Purpose and Duration. IJVs are formed for a specific business objective and can have a limited life span or be long-term. IJVs are frequently established for a limited duration because (a) the complementary activities involve a limited amount of assets; (b) the complementary assets have only a limited service life; and/or (c) the complementary production activities will be of only limited efficacy. Joint Property Interest. Each IJV participant contributes property, cash, or other assets and organizational capital for the pursuit of a common and specific business purpose. Thus, an IJV is not merely a contractual relationship, but rather the contributions are made to a newly formed business enterprise, usually a corporation, limited liability company, or partnership. As such, the participants acquire a joint property interest in the assets and subject matter of the IJV. Reasons for Forming a Joint Venture There are many motivations that lead to the formation of a JV. They include: Risk Sharing – Risk sharing is a common reason to form a JV, particularly, in highly capital intensive industries and in industries where the high costs of product development equal a high likelihood of failure of any particular product. Economies of Scale – If an industry has high fixed costs, a JV with a larger company can provide the economies of scale necessary to compete globally and can be an effective way by which two companies can pool resources and achieve critical mass. Market Access – For companies that lack a basic understanding of customers and the relationship/infrastructure to distribute their products to customers, forming a JV with the right partner can provide instant access to established, efficient and effective distribution channels and receptive customer bases. This is important to a company because creating new distribution channels and identifying new customer bases can be extremely difficult, time consuming and expensive activities. Geographical Constraints – When there is an attractive business opportunity in a foreign market, partnering with a local company is attractive to a foreign company because penetrating a foreign market can be difficult both because of a lack of experience in such market and local barriers to foreign-owned or foreign-controlled companies. Funding Constraints – When a company is confronted with high up-front development costs, finding the right JVP can provide necessary financing and credibility with third parties. Benefits Many of the benefits associated with International Joint Ventures are that they provide companies with the opportunity to obtain new capacity and expertise and they allow companies to enter into related business or new geographic markets or obtain new technological knowledge. Furthermore, International Joint Ventures are in most cases have a short life span, allowing companies to make short term commitments rather than long term commitments. Through International Joint Ventures, companies are given opportunities to increase profit margins, accelerate their revenue growth, produce new products, expand to new domestic markets, gain financial support, and share scientists or other professionals that have unique skills that will benefit the companies. Structure International Joint Ventures are developed when two companies work together to meet a specific goal. For example, Company A and Company B first begin by identifying and selecting an IJV partner. This process involves several steps such as market research, partner search, evaluating options, negotiations, business valuation, business planning, and due diligence. These steps are taken on by each company. There are also legal procedures involved such as IJV agreement, ancillary agreements, and regulatory approvals. Once this process is complete, the IJV Company is formed and during this final procedure the steps taken are formation and management. Management There are two types of International Joint Ventures: dominant parent and shared management. Within dominant parent IJV’s, all projects are managed by one parent who decides on all the functional managers for the venture. The board of directors, which is made up of executives from each parent, also plays a key role in managing the venture by making all the operating and strategic decisions. A dominant parent enterprise is beneficial where an International Joint Venture parent is selected for reasons outside of managerial input. Finance When two or more partners get together and form an International Joint Venture agreement, they must decide early on in regards to what the financial structure will entail as this will aid in management and control. Some of the steps include establishing the capital required to start the IJV, the impact of securing a strong strategic alliance partner, and financial reporting. Once an arrangement is made, a tax-planned joint venture will be created which will aid in maximizing the after-tax returns. Factors affecting IJV Economic Factors Poor formation and planning Problems that arise in joint ventures are usually as a result of poor planning or the parties involved being too hasty to set up shop. For example, a marketing strategy may fail if a product was inappropriate for the joint venture or if the parties involved failed to appropriately asses the factors involved . Parties must pay attention to several analysis both of the environment and customers they hope to operate in. Failure to do this sets off a bad tone for the venture, creating future problems. Unexpected poor financial performance One of the fastest ways for a joint venture is financial disputes between parties. This usually happens when the financial performance is poorer than expected either due to poor sales, cost overruns or others. Poor financial performance could also be as a result of poor planning by the parties before setting up a joint venture, failure to approach the market with sufficient management efficiency and unanticipated changes in the market situation. A good solution to this is to evaluate financial situations thorough before and during very step of the joint venture. Management problems One of the biggest problems of joint ventures is the ineffective blending of managers who are not used to working together of have entirely different ways of approaching issues affecting the organization. It is a well-known fact that many joint ventures come apart due to misunderstanding over leadership strategies. For a successful joint venture, there has be understanding and compromise between parties, respect and integration of the strengths of both sides to overcome the weaker points and make their alliance stronger. Inappropriate management structure In a bid to have equal rights in the venture, there could be a misfit of managers. As a result, there is a major slowdown of decision making processes. Daily operational decisions that are best made quickly for more efficiency of the business tends to be slowed down because there is now a ‘committee’ that is in place to make sure both parties support every little decision. This could distract from the bigger picture leading to major problems in the long run. Cultures Factors When a joint venture is formed, it is literarily an attempt at blending two or more cultures in the hope of leveraging on the strength of each party. Lack of understanding of the cultures of the individual parties poses a huge problem if not addressed. A common problem in these multi-cultural enterprises is that the culture is not considered in their initial formation. It is usually assumed that the cultural issues will be addressed later when the new unit has been created. Usually, compromises are reached and certain cultural from the parties are kept on while others are others are either out rightly discarded or modified. Pros and Cons for IJV The joint venture is becoming a popular way for companies that outsource their operations to retain a piece of the ownership pie. The creation of a new legal entity during the launch of a joint venture comes with its share of ups and downs. On the plus side: Joint ventures enable companies to share technology and complementary IP assets for the production and delivery of innovative goods and services. Joint ventures can be used to reduce political friction and improve local/national acceptability of the company. Joint ventures may provide specialist knowledge of local markets, entry to required channels of distribution, and access to supplies of raw materials, government contracts and local production facilities. In a growing number of countries, joint ventures with host governments have become increasingly important. These may be formed directly with State-owned enterprises or directed toward national champions. On the minus side: A major problem is that joint ventures are very difficult to integrate into a global strategy that involves substantial cross-border trading. In such circumstances, there are almost inevitably problems concerning inward and outward transfer pricing and the sourcing of exports, in particular, in favor of wholly owned subsidiaries in other countries. Problems occur with regard to management structures and staffing of joint ventures. Many joint ventures fail because of a conflict in tax interests between the partners. Disputes Agreements Disputes When two or more partners agree on an International Joint Venture, there are possibilities for disputes to arise. Particularly in IJV’s, there can be issues between the partners who are likely to want their home country’s governing law and jurisdiction to apply to any disputes that may come up; therefore, to avoid such a problem, a neutral governing law and jurisdiction is chosen in some cases. A popular dispute resolution technique used in IJV’s is arbitration; however, many times a court process is given priority as this system has more authority. Other dispute resolution strategies utilized are mediation and litigation. Agreements Entering into an International Joint Venture agreement begins with the selection of partners and then generally this process continues to a Memorandum of Understanding or a Letter of Intent is signed by both parties. The Memorandum of Understanding is a document describing an agreement between parties. On the other hand, a Letter of Intent is a document outlining an agreement between the parties before the agreement is finalized. Examples of successful IJV Sony-Ericsson is a joint venture by the Japanese consumer electronics company Sony Corporation and the Swedish telecommunications company Ericsson to make mobile phones. The stated reason for this venture is to combine Sonys consumer electronics expertise with Ericssons technological leadership in the communications sector. Both companies have stopped making their own mobile phones. Omega Navigation Enterprises Inc. is an international provider of marine transportation services focusing on seaborne transportation of refined petroleum products. One of the vessels, namely the Omega Duke, is owned through a 50% controlled joint venture with Topley Corporation, a wholly owned subsidiary of Glencore International AG (Glencore). They have also formed an equal partnership joint venture company with Topley Corporation, namely Megacore Shipping Ltd.

The sudden change in fate stems from the reality that Zero was actually Hector Zeroni, and was the great-great grandson of Madame Zeroni. The promise was eventually been kept. A Yelnats lifted a Zeroni up to the mountain, carrying the curse and changing his familys fate. Comparison of Stanley Yelnats IV and Kate Barlows Lives Kate Barlow was a humble, kind and intelligent lady. Nobody has thought that this kind lady will turn to become revengeful person and will cause the destruction and unhappiness of someone life. Kate Barlow was a teacher and teaches in a one-room school in Green Lake one hundred and ten years before it was made Camp Green Lake. She was in love with a guy Sam; he sells onions in the town. To him, he will allow the marriage of his daughter with the man who brings the biggest pig. Madame Zeroni helped the great-great grandfather of Stanley on the condition to take her up on the mountain to drink stream water. Her condition to take her up on the mountain was so intense that she would curse him and his generation if he had not taken her up for helping him. Due to some reason he c ould not manage to bring her up on the mountain and they migrated to America. Here he was robbed by Kate Barlow and after that he thinks that he got Madame Zeronis curse. Due to this event Stanley and his family always think in the same manner and believe that they are unlucky and cursed. However, being accused of theft which was false and he had not committed the crime was fiercely unlucky of him because he was punished for the crime which he had never committed. At the end of the trial when he was asked to choose to go either to jail or Green Lake Camp, he chose to go to Green Lake Camp because he had always dreamed of summer camps and thought it one of them. But it was very unfortunate of him when he reaches at the camp and sees that there was neither a lake nor it was green and that his decision of coming here was wrong. Apparently feels himself unlucky because there was so much hardworking involve in the camp. Boys were here to dig for building their characters. He had not real ized that destiny intends to change his life and make him lucky. He began to digging here and one day he realized that the warden is after some treasure. He eventually finds the treasure and got released from camp as a result of being proved that he is innocent. The treasure that he found later came to know that it was the same value which Kate Barlow has robbed from his great-great grandfather and buried it here. Fortune was so much in his favor that his fathers formula also works and it was successful.

A Change of Heart Essay -- Personal Narrative Writing

A Change of Heart Stepping through the revolving glass doors of the hospital felt like entering a completely different world. With my arms crossed over my chest, I followed my parents though the never-ending, eggshell white hallways. My nostrils burned from the fumes of cleaners and sterility. Lovely paintings and luscious plants filled the walkways, trying to mask the hollow, empty feeling that most visitors felt. We passed two types of people along the way to our destination: the kind that strolled by while flashing everyone big, cheery smiles, and the people who kept their gaze straight ahead ignoring your mere existence; I preferred the latter. I did not belong in this place. This was a place for the sick, a place where people went to die. My grandfather did not belong here. We continued walking as my thoughts slipped away to a more pleasant time in my life. I pictured our family tradition of traveling to my grandparents' home every Sunday afternoon. Their quaint little home, white washed with baby blue shutters welcomed any stranger and had a faint honeysuckle aroma that soothed the weariest of souls. We ate lunch together with my grandfather and grandmother sitting like kings and queens at opposite ends of the table. Then everyone gathered in the family room and spent the late afternoon playing games and catching up on the big events of the week. My grandfather spent his time playing with each grandchild one at a time so we would feel special. Anyone could tell that he loved his job as a grandparent. His eyes twinkled with delight and his smile never faded as he spent time with us. He loved throwing us up in the air with his powerful arms, until we squealed with delight as our stomachs flew above our heads. ... ... take a step forward. The situation glimmered with a stream of hope. Reaching his hand out to me, I edged even closer and placed my hand atop his. At that moment, I knew that everything would turn out okay. My grandfather had changed physically but not mentally. I needed his smile to assure me of that. A calming feeling came over me as I walked through the revolving doors and out of the hospital into the bright sunshine. Removing the 200 pounds of iron that sat on my heart and leaving behind the massive building which housed the source of my troubles felt welcoming. I walked away from the situation knowing that my grandfather's personality or love for me did not change. However, my attitude shifted from looking at my grandfather as not being acceptable, to understanding that the only thing that had changed was his physical appearance; he was still the same.

Images of Women in Sport: The Good, The Bad, and The Ugly Essay example

Images of Women in Sport: The Good, The Bad, and The Ugly Throughout history, men have placed limitations on women's activities, including sport. Women have gone through times where physical exertion was considered too stressing for women, physiologically and emotionally, as well as everything short of encouragement. The image of the pre-sport woman, twirling her umbrella while being drawn by horse and carriage attired in full petticoat, etc., is a sight that shows how far women have come, but how much more still has to be done to achieve equality. I view the image of women prior to sport as 'ugly' because not only was their right to partake in sports suppressed, but also their rights as women and as citizens. This image of women, however still persists until modern day. Albeit not to the same degree, but women's opportunities in sport are still less than the male counterpart, as well as the restrictions that this male society still imposes on women's sports, especially through the media. Through poor media coverage of women's sports by mal e-run organizations, the advancement of the sport has suffered tremendously. The television industry poorly advertises women's sporting events, such as basketball, and never shows them in primetime. The US women's soccer association was even dismantled due to lack of support. With publications, the only time women are featured are as either inactive or sex symbols, when editors could be using these media outlets to promote women in sport instead of degrading and downplaying them. Women's sports will never become mainstream without social change. The 'bad' image of women in sport would most definitely have to be the objectified woman whose talent in her sport is overlooked because of her... ... skills in the game. Because of society's prejudices, preconceived notions, and general attitude towards women, this ideal woman athlete is not yet achievable in a society dominated by men. In a society with so many prejudices, men don't want women to be as strong as or stronger than them. The image of women in sport that is 'good' to society is cyclic, since it depends on the state of the culture. Currently, with pop-stars and thinner than ever supermodels, society is definitely in a state of objectification. to the men of this society, who promote such mishaps as Janet Jackson's accident on stage during the Superbowl halftime show, women shouldn't be more than cheerleaders or non-sport related entertainment at major sporting events. Until men realize that women are their equals on all levels, the image of women in sport will never reach its 'good' and ideal image.

Applying the Nursing Code of Ethics to Patient Care Essay -- Nursing P

Nurses have the greatest potential for improving a patient’s well-being. As a profession, nurses need to promote the core values and code of Ethics amongst them. Nurse practitioners are required to understand and practice the specific knowledge and skills of core values such as nurse caring, advocacy, holism and professionalism to assist the patients in their critical condition (Volp 2007a). This essay will discuss the core values of responsible nursing practice and code of ethics in relation to the young patient who is suffering from paraplegia. Paternalism A policy or practice of treating people patients in a fatherly manner, especially by providing for their needs without giving them responsibilities. Paternalistic practices, wherein providers confer a treatment or service upon a person or persons without their consent, ostensibly by reason of their limited autonomy or diminished capacity, are widespread in healthcare and in societies around the world. Numerous issues surround paternalistic practices (Cody WK). So doctors and nurses make decision about the treatment of patients or their clients, but it is against the patient’s choices or thoughts, according to doctors and nurses, it is beneficial for the patient (Jones). On the other hand, when patient take autonomous decision then they will get some self-harm, so, conflict arises between the nurses those are on duty of the patient care and the patient’s right to autonomy. Frequently, nurses and other medical staff used the paternalistic action to resolve the problem (Jo nes). According to the Jones (p.379) suggested that, paternalism and autonomy as two inversely varying parameters along a spectrum of independence’. America in World War 1 Essay

No country enters a war without a reason. United States in not an exception. It entered the World War Two after a tragic Pearl Harbor. It was necessary to stand up and answer to Japanese at that moment. What were United States reasons for entering the World War I? Is there a connection between Russian February Revolution and President Woodrow Wilson decision to enter the Great War? Of course, it could not be a soul reason for declaring a war to Germany; Zimmerman Telegram and German Warfare to Ships played their roles as well. The trigger of the war became an assassination of Archduke Francis Ferdinand, heir to the throne of the Austro-Hungarian Empire, and his wife, Sophie on June 28, 1914. They were killed by Serbian nationalist Gavrilo Princip in Sarajevo, Bosnia. In return for this murder, Austro-Hungary proposed ultimatum to Serbia: â€Å"(1) The Serbian Government would condemn all propaganda against Austria-Hungary and suppress publications and societies that opposed Austria-Hungary. (2) Serbia would ban from its schools books and teachers who did not favor Austria-Hungary. 3) Serbia would dismiss any officials who had promoted propaganda against Austria-Hungary. (4) Austro-Hungary judges would conduct the trial of those accused of the crime at Sarajevo. (5) Serbia had to accept all of these terms within 48 hours or Austria-Hungary would declare war. † Serbia did not agree to some of those ultimatums, which brought to the beginning of the war. Of course, that could not be a reason of the biggest war of that time; that was just a reason. Some of the true reasons were militarism, imperialism and nationalism of that time. Militarism is the race of the military powers of the countries. All countries wanted to have powerful army, navy, to have great ammunitions and guns. At the same time, many alliances were forming in Europe. The mistaken thought was that the alliances would keep peace in the World. That is why the war started between six countries at the same time. One of the alliance that entered the war was alliance of Germany, Austria-Hungary and Italy. The second alliance was Britain, France and Russia. Nationalism at that time became big deal. Patriots of their countries were competing for the biggest force they have. Imperialism was one of the reason of the war as well. At the beginning of the twentieth century Britain, France and other countries had colonies all over the world. They were invading more and more of new African and Asian lands. Germany decided to enter a war to get those colonies. Germany supported Austria-Hungary in the war. At the same time, the Russian supported Serbia. That is how the war between Germany and Russian were declared. France and Britain supported Russian, so the war expanded to them as well. By the beginning of the August, most of the Europe were involved in the battle. On August 4, 1914 America’s President Woodrow Wilson declaring neutrality to the war. At the time, America did not see an important reason to enter this war. Even at a neutral position, America favored Allies, by sending war supplies and lending enormous amounts of money to France and Britain. This is a good position for America and the economy is booming. In the beginning of 1915 Germany pronounced, â€Å"all the waters surrounding Great Britain and Ireland, including the whole of the English Channel, be a war zone. † First strike of war that torched United States directly was a sinking of Lusitania, a British luxury ocean liner. Germany submarine torpedoed it on May 7, 1915, killing 1198 people on board. 128 of those who died were Americans. Germany claimed that Lusitania were caring ammunition for Allies. Later Germany sunk few small passenger ships. Many warnings were sent to German government, and were accepted. Germany were apologizing each time and making promises not to fire without warning. On March 24, 1916 Sassex, French boat were sunk by German submarine; four Americans were killed. At first, Germany did not even confess that it was a German submarine, which sunk Sassex. Germany were afraid that United States would enter the war, knowing the power and ammunition of the America. On January 31, 1917 â€Å"Germany declared the resumption of its submarine campaign. † Why did not United States enter the war at that time, when German submarines killed so many innocent Americans? Many historians will tell that one of the main reasons for America to enter World War I was the Zimmerman Telegram. In February 1917 President Wilson got a copy of the coded not from German Secretary of Foreign Affairs Zimmerman to German Minister in Mexico Eckardt. It stated that if America will enter a war, Mexico would enter an alliance with Germany on return to Mexico’s lost territory. The telegram was received from Britain who could capture and decode it. The telegram was published in United States and helped change the view of Americans of the World War I. People realized that American’s entry to the war is real. Meanwhile Russia straggled not only with the war but also with the starvation and poverty. Russian entered the war on August 1, 1914 and had a good beginning. By the end of 1915, Russian lost almost all positions gained at the beginning of the war. Poland, Lithuania, Galicia, part of the Baltic States and Belarus are lost. By the end of year 1916 Russia lost more than three and a half million people in war, and about two million people were taken prisoners. Russia straggled a lot with the war. The whole country were working for the army. People were hungry and mad. The winter of 1916 -1917 were very cold and people dying from cold and starvation. On February 23, 1917 protest started. Almost 90 thousands of women left their jobs at manufactories and went on the streets to protest against hunger, poverty and autocracy. Their posters were asking for bread, change of the government and war end. Next day almost twice more people came out on the street demanding the changes. In two days whole city Petrograd was in revolutionary mood. Soldiers opened fire and killed some of the revolutionists, but it did not stop people. Czar Nicolas II was not at Petrograd at the time of revolution and did not believe the size and seriousness of the situation. On March 15, 1917 Czar abdicated. New government Temporary Committee of the state Duma were proposing â€Å"freedom of speech, press and assembly as well as the abolition of restrictions based on class, religion, and nationality. Elections would be based on universal, equal, and direct suffrage and secret ballot. These initiatives closely resemble many aspects of American and democratic principles. Much of their wording is almost identical to what is written in the United States Bill of Rights. † The whole world is aware of the Russian Revolution almost immediately. America is deciding if it wants to support a new government or not. Colonel Edward House sends a letter to Wilson trying to convince him to congratulate and support new government in Russia. Wilson agrees and America is a first country that recognizes Duma. Soon, Great Britain, France and Italy join America. Now when Russia becomes a democratic country America can enter a war and reason it as a democracy brining to Europe countries. On March 20. 1917 the cabinet meeting began. The main questions that were discussed during four days were Russian revolution and Americas entry to the war. On April 2, 1917, American President Wilson gave a speech in the Congress and ask tried to convince to declare the war to Germany. On April 6. 1917 the war between United States and Germany was declared. On April 15, 1917 President asked Americans to â€Å"do their bit for America† and participate in the war for democracy in the whole world.

Finally, the polluter pays principles is now seen in specific pieces of legislation becoming more (or some king say less) than a one thousand integral statement of an intractable gay right. OECD the birth of the polluter pays principle most explanation of the sometimes arbitrary argument of the principle of polluter pays can be found in its historical schooling.T he principle first appeared in a legal context in a document prepared by the international arrangement for Economic Cooperation and cultivation (OECD) and included the avocation recommendation The principle to be character for allocating costs of pollution prevention and supremacy measures to encourage rational commit of scantily environmental resources and to avoid distortions in international parcel out and investment is the so-called Polluter Pays principle. This principle means that the polluter should bear the expenses of carrying out the above mentioned measures decided by macrocosm authorities to pick up that the environment is in an acceptable state. In other words, the cost of these measures should be reflected in the costs of goods and services which cause pollution in production and/or consumption. such measures should non be accompanied by subsidies that would create significant distortions in international cunning and investment. In 2001, the OECD joint Work ing Party on horticulture and Environment, after years of gestation and development by other organisations, stated that a new and expanded form of the polluter pays principle should ply that the polluter should be held responsible for environmental damage caused and bear the expenses of carrying out pollution prevention measures or paying for damaging the state of the environment where the consumptive or productive activities create the environmental damage are non covered by keeping rights. get together Nations the Rio Declaration This proclamation was proved, at to the lowest degree on paper, if non yet by jus cogens, in 1992 when the linked Nations Conference on the Environment and Development delegates agreed on the Rio Declaration on Environment and Development (the Rio Declaration), which has been described as an puppet of international jurisprudence that articulates policies and prescriptions directed at the achievement of worldwide sustainable development. It is of note that Principle 16 of the Rio Declaration provides that national authorities should endeavour to promote the internalization of environmental costs and the use of economical instruments, taking into account the approach that the polluter should, in principle, bear the cost of pollution, with overdue regard to the public interest and without distorting international trade and investment. The principles appearance in such a seminal statement of the undamental principles of international environmental law demonstrates its significance in environmental liability regimes around the world. United nations The principle has to some termination informed United States legislation, but its influence should not be overstated and commentators note that The United States, in contrast to the European nations, does not officially recognize the polluter pays principle as a lucid principle or policy mandate, but does, by natural political and economic inclination, closely follow its prece pts in send.Certain provisions of the United States unclouded diffuse actuate 1970 (the CAA) and Clean irrigate Act 1977 (the CWA) require polluters to satisfy environmental standards at their own expense and the spaciotemporal Environmental Response, Compensation and Liability Act of 1980 (CERCLA) assigns liability for costs associated with cleaning-up sites contaminated by hazardous wastes. CERCLA is a notable milepost in the development of the polluter pays principle in the United States and commentators have historied that the polluter pays principle is one of the of import objectives or goals of CERCLA.Flaws in the Polluter Pays Principle Few people could disagree with what seems at first glance to be such a straightforward proposition. Indeed, properly construed, this is not exclusively a sound principle for dealing with those who pollute but is an book of facts of one of the most basic principles of uprightness and justice people should be held responsible for their actions. Those who cause damage or ill-treat to other people should pay for that damage. This appeal to our sense of justice is why the polluter pays principle (PPP) has come to resonate so strongly with both policy makers and the public. As a general rule, sound economic analysis of pollution and environmental problems moldiness also be base on the principle of responsibility. Forcing polluters to bear the costs of their activities is good economics too it not only advances f bareness and justice, but also enhances economic capacity. In other words, with appropriate policies based on a PPP, we should not have to give up the economic efficiency of a free market arranging based on snobbish property in order to bump environmental protection, nor vice versa. nevertheless as with most such general principles, the devil is in the details. In this case, the details relate to trip permit basic questions that any occupation of the PPP must answer. First, how do we define pollution and in that respectfore a polluter? Second, how such(prenominal) should the polluter pay, once he is identify? Third, to whom should the payment be made? The answers to these questions are at the nerve of whether any application of the PPP will be either just or economically efficient.A correctly construed polluter pays principle would punish those who injure other people by wronging their persons, or by degrading their property. in addition often, however, the PPP is mis delineate and misused to suppress private economic activity that benefits the parties at a time convolute and does no specific damage to other people, but which offends those who oppose humans match on the environment and prefer to go out resources undeveloped. The objective is to restrain the resource use at the expense of the property owners and consumers without cost to those who wish to see the resources remain idle. low such a misapplication of the PPP, truly often a polluter is not someone who is harming others, but is someone who is but using his own property and resources in a way that is not sanctioned of by disposal officials or environmentalists. In such cases there is no harm to be measured and no subsisting victims to compensate. Consequently, the amount to be paid is not determined by the extent of any actual damage done. Rather, it is set at a level that curbs the politically disfavored activity to the degree desired by its opponents. And finally, the payment (whether there are real victims or not) typically goes to the government in the form of a tax. In other words, in most cases, the PPP is used as cover to promote a political or ideological agenda earlier than to ensure that real polluters pay fee to real victims of their activities. temperamental and Legislative Measures capital of Sweden Declaration of 1972 was perhaps the first major attempt to conserve and protect the human environment at the international level. As a termination of this Declaratio n, the States were postulate to adopt legislative measures to protect and emend the environment.Accordingly, Indian Parliament inserted two articles, i. e. ,, 48A and 51A in the Constitution of India in 1976, Article 48A of the Constitution justifiedly directs that the State shall endeavour to protect and reform the environment and safeguard forests and wildlife of the country. The enunciate protect and improve appea ring in both the Articles 48A and 51A (g) seems to contemplate an affirmative government action to improve the quality of environment and not just to preserve the environment in its degraded form.Apart from the constitutional mandate to protect and improve the environment, there are a plenty of legislations on the subject but more relevant enactments for our purpose are the pissing (Prevention and manipulate of befoulment) Act, 1974 the Water (Prevention and tame of taint) Cess Act, 1977 the fashion power (Prevention and obligate of defilement) Act, 1981 the Environment (Protection) Act, 1986 Public Liability insurance policy Act, 1991 the discipline Environment Tribunal Act, 1995 and the National Environment Appellate Authority Act, 1997 the Wildlife (Protection) Act, 1972 the afforest (Conservation) Act, 1980.The Water Act provides for the prevention and look into of weewee pollution and the maintaining or resorting of the wholesomeness of water.
